Launching an online business does not automatically mean that you need a GST number from the first sale. A person selling handmade products through Instagram, providing web-design services from home or operating a small online store may legally remain outside GST registration while another online business with similar revenue may be required to register.
Yes, it can be legal to run an online business without GST registration in India. Whether registration is compulsory depends on factors such as your aggregate turnover, whether you sell goods or services, the State from which you operate, whether supplies are inter-State, and whether you sell through an e-commerce operator.
The important point is that being “online” is not itself the test for GST registration.

What Is the Basic GST Registration Rule?
Section 22 of the Central Goods and Services Tax Act, 2017 provides the basic turnover-based registration framework.
For suppliers of services, the general registration threshold is ₹20 lakh in aggregate turnover in a financial year, with a ₹10 lakh threshold applying in specified special-category States.
For persons engaged exclusively in supplying goods, the Government has provided an enhanced threshold of ₹40 lakh in States and Union Territories where the relevant notification applies. A lower threshold applies in specified States.
However, turnover is only the starting point.
Section 24 contains circumstances in which compulsory registration may apply independently of the normal turnover threshold, although exemptions and subsequent notifications have modified some of these situations.
What Does Aggregate Turnover Mean?
A common mistake is to calculate the GST threshold separately for each website, marketplace account or business activity.
Aggregate turnover is calculated on an all-India basis for the same PAN.
Broadly, it includes the aggregate value of:
- Taxable supplies;
- Exempt supplies;
- Exports; and
- Inter-State supplies
of persons having the same PAN, subject to the statutory exclusions.
Suppose you provide online marketing services under one brand and also operate another online business under the same PAN.
You generally cannot automatically claim a separate ₹20 lakh threshold for each brand.
Their relevant turnovers are considered together for determining aggregate turnover.
Can a Freelancer Work Without GST Registration?
Yes, in appropriate circumstances.
Suppose an independent graphic designer provides services from India and has annual aggregate turnover of ₹8 lakh.
Merely finding clients online does not automatically make GST registration compulsory.
The same can apply to activities such as:
- Content writing;
- Website development;
- SEO services;
- Graphic designing;
- Digital marketing;
- Online consulting;
- Virtual assistance; and
- Other professional services.
The freelancer must still examine the nature and location of supplies and whether any compulsory-registration provision applies.
What If You Provide Services to Clients in Other States?
This is another area where outdated GST advice causes confusion.
Section 24 contains a compulsory-registration provision relating to inter-State taxable supplies. However, the Government has granted an exemption from registration to eligible persons making inter-State taxable supplies of services where their aggregate turnover remains within the applicable threshold.
Therefore, a freelancer below the relevant threshold does not necessarily need GST registration merely because a client is located in another Indian State.
Other circumstances can still affect the position, so the complete business model should be considered.
Can You Sell Products Through Your Own Website Without GST?
Potentially, yes.
Suppose you manufacture handmade products and sell them directly through your own website.
The fact that customers place orders online does not by itself make you a marketplace seller.
If the website is simply your own sales channel and you are selling your own products, the normal registration rules need to be considered based on your supplies, turnover and other applicable conditions.
Operating your own website should also be distinguished from operating an e-commerce platform through which other sellers make supplies.
An e-commerce operator can have separate GST obligations.
Do Amazon, Flipkart or Other Marketplace Sellers Need GST Registration?
The law in this area changed significantly from 1 October 2023.
Previously, suppliers of goods through e-commerce operators required to collect TCS were generally subject to compulsory GST registration even if their turnover was below the normal threshold.
The Government subsequently waived this mandatory-registration requirement for qualifying unregistered suppliers of goods through e-commerce operators, subject to prescribed conditions.
This means it is now possible for an eligible small seller to sell goods through a qualifying e-commerce marketplace without obtaining normal GST registration.
But the exemption is conditional.
What Conditions Apply to Unregistered Marketplace Sellers?
Under the special framework for unregistered suppliers selling goods through e-commerce operators, important conditions include:
- The seller must remain within the applicable GST registration threshold.
- The seller must not make inter-State supplies of goods through the e-commerce operator under this exemption.
- The seller must not make supplies through the e-commerce operator in more than one State or Union Territory.
- The seller must have a PAN.
- The seller must obtain an enrolment number on the GST common portal in accordance with the prescribed procedure.
- The e-commerce operator must comply with the special reporting procedure applicable to such supplies.
Therefore, “No GST registration” does not mean “no GST compliance at all.”
A small seller using this facility must satisfy the conditions prescribed for the exemption.
Can You Sell Goods to Customers in Other States Without GST Registration?
This requires particular caution.
The special exemption allowing unregistered persons to sell goods through e-commerce operators is designed around intra-State supplies.
If you intend to make inter-State taxable supplies of goods, you should separately examine the registration provisions and applicable exemptions before accepting orders.
This distinction is particularly important for online stores because a website can receive orders from anywhere in India.
Do not configure nationwide delivery first and investigate GST implications later.
What About Selling Through Instagram or WhatsApp?
Instagram, WhatsApp and similar platforms are frequently used to find customers, but the tax position depends on the actual transaction structure.
For example, suppose you display handmade candles on social media, customers message you directly, payment comes directly to you and you arrange delivery yourself.
Your GST registration requirement must be determined from your turnover, nature of supplies, place of supply and applicable compulsory-registration provisions.
Simply having an Instagram business account does not automatically create GST liability.
Similarly, accepting payment through UPI does not by itself require GST registration.
What If You Sell Only GST-Exempt Products?
Section 23 of the CGST Act provides that a person engaged exclusively in supplying goods or services that are wholly exempt from GST or not liable to tax is not liable to registration under the provision.
Therefore, turnover alone should not be examined without considering what the business actually sells.
If your business includes both taxable and exempt supplies, however, the analysis can change because aggregate turnover includes exempt supplies for threshold purposes.
Does Having a Shopify or WooCommerce Store Require GST?
No GST registration requirement arises merely because you use a particular website-building or e-commerce technology.
A Shopify store, WooCommerce website or custom e-commerce website is essentially a method of conducting the business.
GST liability depends on the underlying supplies and statutory registration provisions.
The software platform does not determine whether your business is legally required to have a GSTIN.
Can You Voluntarily Register for GST?
Yes.
Section 25 permits voluntary registration even where a person is not otherwise liable to register.
A small online business may choose voluntary registration for commercial reasons.
For example, registration may be useful where the business:
- Mainly serves GST-registered business customers;
- Wants eligible input tax credit;
- Expects turnover to cross the threshold soon;
- Plans to expand its supply model; or
- Wants a GST-compliant structure from the beginning.
But voluntary registration also brings ongoing compliance obligations, including applicable returns and record-keeping.
It should therefore be a considered business decision rather than simply obtaining a GSTIN because it looks more professional.
What Happens When Your Turnover Crosses the Threshold?
Once your business becomes liable for GST registration, you should not continue operating indefinitely as an unregistered business.
Section 25 generally requires a person who becomes liable to registration under Section 22 or Section 24 to apply within 30 days from the date the liability arises.
Businesses should monitor turnover throughout the financial year instead of checking it only when preparing income-tax returns.
Keep proper records of:
- Sales invoices;
- Marketplace sales;
- Website orders;
- Bank receipts;
- UPI transactions;
- Refunds;
- Exempt supplies; and
- Sales through different business names under the same PAN.
Can You Charge GST Without GST Registration?
No unregistered business should simply add “18% GST” to an invoice and collect it from customers as though it were a registered taxable person.
A GSTIN is not merely an optional number printed on invoices.
If you are not registered, your invoices should not falsely represent that you are collecting GST as a registered supplier.
Once properly registered, the applicable tax rate, invoice requirements and return obligations must be followed.
Does No GST Registration Mean No Income Tax?
Absolutely not.
GST and income tax are separate systems.
A business may be below the GST registration threshold and still earn taxable income for income-tax purposes.
For example, an online consultant earning ₹12 lakh may not necessarily require GST registration solely on the basis of turnover, but their business income still has to be considered under the applicable income-tax provisions.
Similarly, maintaining business records remains important even if GST registration is not required.
What Should an Online Business Check Before Operating Without GST?
Before deciding that you do not need registration:
- Calculate aggregate turnover for the entire PAN.
- Identify whether you sell goods, services or both.
- Check the threshold applicable in your State.
- Determine whether your supplies are intra-State or inter-State.
- Check whether Section 24 creates compulsory registration in your situation.
- Consider exemptions from compulsory registration.
- Check special rules if selling through an e-commerce operator.
- Complete GST portal enrolment where required for unregistered marketplace selling.
- Monitor turnover throughout the year.
- Do not collect GST from customers without proper registration.
- Maintain proper sales and payment records.
- Review the position before expanding into new States or sales channels.
The correct question is therefore not simply “Is my business online?” It is “Do my turnover, type of supply, location of customers and method of selling make GST registration compulsory?” A genuinely small online business can legally operate without GST registration in several situations, but the exemption must fit the actual business model.
